All entrusted parties are bound by a strict confidentiality agreement including a contractual obligation to implement appropriate security measures to protect the Personal Data shared with them and to process such data solely within the scope of the work outsourced.
Arashi House may also disclose specific information when such disclosure appears necessary to comply with the law, a subpoena or other litigation process or to protect the interests or safety of its visitors and customers, Arashi House employees or others.
As Arashi House is part of an international network your Personal Data may be transferred abroad, even temporarily, in accordance with applicable legislation, by adopting all appropriate security measures and safeguards to ensure an adequate level of data protection and security.
Your Personal Data will not be used for third-party advertising purposes or for the promotion of products, services or initiatives by entities other than the Arashi House, nor shall they be disclosed to unknown persons under any circumstances.

Data communication within Arashi House
Please also note that if you agree to register for the purposes referred to in Section 2, letters (e)-(g), the Personal Data of your profile into the Arashi House customer database will be automatically visible to, and securely shared with, all Arashi House stores globally to provide you with the same quality of service wherever you choose to interact with us around the world (i.e. when you travel and purchase our products or visit our stores). Arashi House will take all appropriate and suitable security and confidentiality measures as required by applicable legislation to ensure an adequate standard of data protection.

6. Retention period
Your Personal Data will be processed and stored for: (a) as long as required to carry out the purposes for which the Personal Data was collected, (b) in accordance with the storage periods provided for by the applicable laws, or (c) until you revoke your consent to the processing/storage of your Personal Data, if applicable. After the conclusion of such period(s), and where there is no legal or business purpose for retaining your Personal Data, it will be automatically and permanently erased or made anonymous.
In particular, regarding the data processing of registered members into Arashi House customer database:

  • Personal Data of your membership account are kept for a period of 7 years from the date of your last interaction with the Arashi House or otherwise until you withdraw from or cancel your registration in the Arashi House customer database; and

  • Purchase details are kept for a period of 7 years from the date of purchase.

1. Definitions

In these terms and conditions (“the Terms”), unless otherwise specified:

1.1 “Cancellation Fee”: 1% of the value of the goods on Lay-by.
1.2 “Completion Date”: The earlier of the last day of the Lay-by Period or the date of cancellation by Arashi House.
1.3 “Lay-by”: A facility where goods are reserved under your name while payment is made over time.
1.4 “Lay-by Period”: A 3-month period from the Lay-by's opening date.
1.5 “Arashi House”: The operator of the Lay-by facility.
1.6 “PI”: Personal Information, as defined under the Protection of Personal Information Act 4 of 2013 (“POPIA”), and "Processing" is as per POPIA.
1.7 “We, us, our”: Refers to Arashi House.

2. Use of the Lay-by Facility

2.1 By opening a Lay-by, you agree to these Terms.
2.2 Certain goods may not be eligible for Lay-by.
2.3 Only individuals aged 18 or older with valid legal capacity can open a Lay-by. South African citizens must present an ID book, ID card, or driver’s license. Foreign nationals must present a valid passport (driver's licenses not accepted).
2.4 Minimum deposit: 20% of the total purchase price.
2.5 Up to three active Lay-bys are permitted at any time.
2.6 Arashi House reserves the right to decline future Lay-bys if two are canceled within a 12-month period.
2.7 Ensure accurate contact details are provided and updated as necessary.
2.8 Goods are held until fully paid for and can only be collected once the balance is cleared.

3. Payment Terms and Statements

3.1 A deposit of 20% is required upon opening the Lay-by.
3.2 Remaining balance will be divided into three equal monthly installments.

 

Example:

  • For a R1,000 Lay-by:

    • Deposit: R200 (20%).

    • Remaining balance: R800 (3 monthly payments of R266.66).

Total: R1,000 (R200 deposit + 3 monthly payments).


3.3 A minimum monthly payment of 50% of the installment amount is required.
3.4 Full payment must be completed within the Lay-by Period (3 months).
3.5 Statements will be sent monthly via email or SMS, detailing transactions, due payments, and balances.
3.6 Verify statements and report discrepancies within 30 days.

 

4. Cancellation

4.1 Lay-bys may be cancelled for non-payment after seven days’ notice via email.
4.2 If cancelled, the Completion Date is the cancellation date.
4.3 Failure to pay the balance within 60 business days post-Completion Date will result in cancellation.
4.4 In cases where goods are lost, destroyed, or damaged, the Lay-by will be cancelled, and payments refunded.
4.5 Notifications of cancellations will be sent via email or SMS.

5. Cancellation Fee

5.1 A Cancellation Fee of 1% will apply if:

  • You cancel before full payment.

  • Payment is not completed within 60 business days post-Completion Date.
    5.2 Refunds will be processed minus the Cancellation Fee.
    5.3 No Cancellation Fee applies in cases of hospitalization or death.

 

6. Personal Information

6.1 Arashi House will process Personal Information per POPIA. For more details, see our Privacy Policy.
6.2 You consent to your Personal Information being used for Lay-by maintenance, identity verification, and marketing (if opted in).
6.3 PI may be shared with third parties like payment processors, fraud prevention agencies, or regulatory authorities as required by law.

 

7. Direct Marketing

7.1 If opted in, Arashi House may send promotional offers and updates via email or SMS.
7.2 Opt-out at any time by contacting customer service.
7.3 Ensure contact details are accurate to receive marketing communications.

8. Adjustments to Your Lay-by

8.1 Removing Items:

  • If you wish to remove any items from your Lay-by, you will need to cancel the existing Lay-by agreement.

  • Upon cancellation, the total amount you have paid will be refunded, less the applicable Cancellation Fee.

8.2 Opening a New Lay-by:

  • Once the original Lay-by is canceled, you may open a new Lay-by agreement for the remaining items.

  • The terms of the new Lay-by agreement, including the deposit and installment structure, will apply as outlined in these Terms.

 

9. Additional Terms

9.1 Lay-by is available only for full-priced items and is not affected by sales or discounts.

9.2 Lay-by payments must be completed within 3 months, as per the agreed payment plan.
